Drug Crimes

Being charged with a drug crime carries a heavy price in our society especially if you are innocent of the charges. Many think drug crimes a minor in relationship to other crimes but hey are not. You potentially face strong and lengthy criminal sentences and most likely will have to register as a drug offender in your local community if convicted. These types of charges can destroy your reputation, job relationships and personal relationships. These types of allegations quite simply destroy lives.

These types of crimes are usually viewed as victimless crimes because they only have to do with the person who is using or is under the influence however, the state view them as precursors to violent crimes and therefore prosecutes them vigorously.

These crimes can be prosecuted in either State or Federal Courts. In the Federal system if convicted, the punishment is severe and you will have to do 85% to 90% of your sentence.

It is vital to hire an experienced criminal defense attorney when you are being charged with these crimes. It is equally as important when you are being investigated relating to any accusations involving drugs. You need someone experienced and aggressive like Gregory B. Avoid Jail and Prison through drug treatment

Because of the severity of theses types of crimes I work to find every loophole and exception to place in a diversion program such as P.C. 1000 or through Prop 36. It can be done in even serious cases where the state has filed multiple drug charges which would seemingly not allow a person to become eligible for a diversion program, one that allows you to stay out of jail and prison and instead be placed on probation and attend a drug rehabilitation program. Thereafter, after successful completion of probation your case can be dismissed!

Below I talk about some of these Drug Crimes, the code sections, the elements of each crime and the punishments attached to each one. It is not an exhaustive list but does give you the most serious ones.

Possession

Straight possession of a controlled substance can carry with it a state prison sentence of 16 months 2 or 3 years. (Penal Code Section 11350) or can be a trivial as possession of less than 28.5 grams of marijuana and carries with it a fine of $100. (Penal code Section 11357)

However, for straight possession for personal use there are two programs to divert you out of the system and into drug rehabilitation centers which keeps you out of local jail custody and state prison. There are Prop 36 and P.C. 1000.

The purpose of diversion is to attempt to help or rehabilitate the drug offender, give him or her a drug treatment program that will hopefully address the problem and fix the problem. Sometimes this works and sometimes it does not. Much of it is up to the individual person as to whether or not he or she really wants to be rehabilitated. Because of that and the personal struggles attendant to rehabilitation, people reoffend at times and find themselves back in the criminal justice system. It depends on why they are back; for instance, if they were kicked out of the program the court can give them another chance pursuant to the provisions of Prop 36. the whole purpose is to keep non-violent offenders out of jails and prisons and back into society where they can hopefully be a productive citizen.

Many times when a person is arrested for a drug offense they are charged with multiple counts including straight possession or being under the influence coupled with transportation or manufacturing for instance which, if proven, takes them out of the possibility to be diverted out to drug rehabilitation centers. This area of the law gets very complex. That is the reason why you need to pick an experienced drug crimes attorney.
