Rape
Rape (Penal Code Section 261)
"(a) Rape is the act of sexual intercourse accomplished with a person not the spouse of the perpetrator, under any of the following circumstances:"
- Where the person is incapable, because of a mental disorder or developmental or physical disability, of giving legal consent and you know of this or reasonably should know.
- Where it is accomplished against the person's will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person.
- Where the person is prevented from resisting by any intoxicating or anesthetic substance, or any controlled substance and you know this or reasonably should.
- Where the person is unconscious of the nature of the act and you know it. Unconscious has a variety of meanings in the law.
- Where a person submits believing it is that person's spouse and this belief is induced by any artifice, pretense, or concealment practiced by the accused, with the intent to induce the belief.
- Where the act is accomplished against the victim's will by threatening to retaliate in the future against the victim or any other person, and there is a reasonable possibility that the perpetrator will execute the threat. (threatening to retaliate means a threat to kidnap or falsely imprison, or to inflict extreme pain, serious bodily injury, or death)
- Where the act is accomplished against the victim's will by threatening to use the authority of a public official to incarcerate, arrest, or deport the victim or another and the victim has a reasonable belief that the perpetrator is, in fact, a public official.
Spousal Rape (Penal Code Section262)
It is sexual intercourse accomplished under any of the following circumstances;
- Against the person's will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on that person.
- Where the spouse is prevented from resisting by any intoxicating or anesthetic substance, or any controlled substance and you know or reasonably should know that is the case.
- Where your spouse is unconscious of the nature of the act and you know it. the word "unconscious" has several meanings as used in this section.
- Against the person's will where there is the threat of retaliation in the future.
- Against the person's will by threatening to use the authority of a public official to incarcerate, arrest, or deport the spouse or another person.
Punishment (Sections 261 & 262)
3, 6 or 8 years in the State Prison
5, 7 or 9 years in the State Prison for gang rape

Lewd or Lascivious Acts with Child under 14 (Child Molestation)
Penal Code Section 288
"Any person who willfully and lewdly commits any lewd or lascivious acts, including an other acts constituting other crimes provided for in Part I, upon or with the body, or any part, or member thereof, of a child who is under the age of 14 years, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of that person or the child, is guilty of a felony.."
Punishment: 3, 6 or 8 years in the State Prison for one victim
15 years to Life in the State Prison (Multiple victims)
25 years to Life in the State Prison (Certain situations apply)
**Your age vs. the "victim's" age is important.
**Fines can be levied against you up to $10,000 by the court.

Continuous Sexual Abuse of a Child (Child Molestation)
Penal Code Section 288.5
"(a) Any person who either resides in the same home with the minor child or has recurring access to the child, who over a period of time, not less than three months in duration, engages in three or more acts of substantial sexual conduct with a child under the age of 14 years at the time of the commission of the offense...or three or more acts of lewd or lascivious conduct under Section 288, with a child under the age of 14 years at the time of the commission of the offense.."
Separate counts may be charged against you if there is more than one victim.
Punishment: 6, 12, or 16 years in the State Prison

Assault Resulting in Death of a Child (Child Abuse)
Penal Code Section 273ab
"Any person who, having the care or custody of a child who is under eight years of age, assaults the child by means of force that to a reasonable person would be likely to produce great bodily injury, resulting in the child's death, shall be punished by imprisonment in the state prison for 25 years to life."
This code section is frequently charged in a suspected Shaken Baby Syndrome case; a case where the allegations are that a person shakes a baby or infant usually under the age of 2 years and because of the neck muscles that are not yet mature and strong enough, and the brain has not fully developed, that back and forth motion similar to a whiplash causes the brain to impact the skull which causes bleeding and swelling and in some cases death. These cases involve caretakers, in many cases boyfriends, girlfriends, fathers and mothers, family members and usually involves a person getting angry with the youngster and subsequestly abusing him or her.
Because of the severity of the punishment, a vigorous defense is required utilizing experienced investigators and forensic medical experts. It carries the same punishment as first degree murder and the same as a third striker.

Sodomy
Penal Code Section 286
"(a) Sodomy is sexual conduct consisting of contact between the penis of one person and the anus of another person. Any sexual penetration, howver slight, is sufficient to complete the crime of sodomy."

Oral Copulation
Penal Code Section 288a
"Oral copulation is the act of copulating the mouth of one person with the sexual organ or anus of another person.”
Punishment:
- Commit this act with a person under the age of 18 and, with exceptions, you can either go to jail for no more than 1 year (misdemeanor) or go to State Prison for 16 months, 2 or 3 years (felony). This is called a “wobbler” as it can be a misdemeanor or a felony.
- If you’re over 21 and you commit this act with a person under the age of 16 you will, with exceptions, be charged with a felony with punishment in the State Prison for 16 months, 2 or 3 years.
- If you commit this act with a person under the age of 14 and that person is more than 10 years younger than you, the maximum punishment is 3, 6 or 8 years in the State Prison.
- If you commit this act against the victim’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the victim the maximum punishment is 3, 6 or 8 years in the State Prison.
- If you commit this act against the victim’s will by threatening to retaliate in the future against the victim or any other person, and there is a reasonable possibility that you will execute the threat or, the victim is unconscious** of the nature of the act and you know it or reasonably should know it, or if the victim is prevented from resisting by any intoxicating or anesthetic substance, or any controlled substance, and you knew it or reasonably should have, or if the victim submits under the belief that you are the victim’s spouse, and this belief is induced by any artifice, pretense, or concealment practiced by you, with the intent to induce that belief in the victim, or if you threaten to use the office of a public official to incarcerate arrest or deport the victim or another and the victim has a reasonable belief you are a public official the maximum punishment is 3, 6 or 8 years in the State Prison.
**The word “unconscious” has several meanings in relationship to this section and is very complex.
- I you act together with another to commit this act, either personally or by aiding and abetting, in ways set forth in #’s 4 and 5 above, or where the victim is incapable, because of a mental disorder or developmental or physical disability, of giving consent and you know it or reasonably should know it, the maximum punishment is 5, 7 or 9 years in the State Prison.
IMPORTANT NOTICE: Anyone convicted of this section MUST register as a sex offender pursuant to Penal Code Section 290 for the rest of their life!

Incest
Penal Code Section 285
"Persons being within the degrees of consanguinity within which marriages are declared by law to be incestuous and void, who intermarry with each other, or who commit fornication or adultry with each other.."
Punishment: 16 months, 2 or 3 years in the State Prison

Indecent Exposure
Penal Code Section 314
Lewd or obscene conduct; indecent exposure;obscene exhibitions
"Every person who willfully and lewdly either:
- Exposes is person, or the private parts thereof, in any public place, or in any place where there are present other persons to be offended or annoyed thereby, or,
- Procures, counsels, or assists any person so to expose himself or take part in any model artist exhibition, or to make any other exhibition of himself to public view, or the view of any number of persons, such as is offensive to decendcy, or is adapted to excite to vicious or lewd thoughts or acts is guilty of a misdemeanor."
And, if you violate that section after entering, without consent, in an inhabited dwelling house, or trailer coach, or the inhabited portion of any other building you can be punished by either imprisonment in the county jail for 1 year of tin the State Prison for 16 months, 2 or 3 years.
